By accessing or using the Domera platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We may update these Terms from time to time; continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
2. Use of Service
You may use Domera only for lawful purposes and in accordance with these Terms. You agree not to use the Service in any way that violates applicable federal, state, local, or international law or regulation. You must not transmit any unsolicited or unauthorized advertising, spam, or any other form of solicitation. Domera reserves the right to terminate access for violations of these Terms.
3. User Accounts
To access certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify Domera immediately at contact@domera.com if you suspect any unauthorized use of your account. Domera is not liable for any loss or damage arising from your failure to protect your account information.
4. Agent Listings
Real estate agents who register on Domera represent that all information provided, including rebate percentages, listing fees, and service areas, is accurate and compliant with applicable real estate regulations in their jurisdiction. Domera does not independently verify agent claims and is not responsible for any misrepresentations made by agents. Buyers are encouraged to confirm all rebate terms in writing with agents before entering into any agreement.
5. Payments and Premium Features
Certain features of the Service require a paid subscription ("Premium"). Payments are processed by third-party payment processors. All fees are non-refundable except as required by law or as expressly stated in our refund policy. Domera reserves the right to change pricing at any time, with notice provided to existing subscribers. Premium subscriptions automatically renew unless cancelled before the renewal date.
6. Disclaimers
The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. Domera does not warrant that the Service will be uninterrupted, error-free, or free of viruses. Domera is a marketplace platform and is not a licensed real estate broker, agent, or advisor. Nothing on the Service constitutes legal, financial, or real estate advice. You should consult qualified professionals before making any real estate decisions.
7. Limitation of Liability
To the fullest extent permitted by applicable law, Domera shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Service. Domera's total liability to you for any claims arising from use of the Service shall not exceed the greater of $100 or the amount you paid Domera in the twelve months prior to the claim.
